1. About these Terms

These Terms govern your use of KiwiArcadeHub.com and related services (the “Service”), provided by KiwiArcadeHub Limited (“we”, “us”). By using the Service, you agree to these Terms and our posted policies.

2. Eligibility & accounts

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for your account, security, and all activity under it.
• Provide accurate information and keep it up to date. We may suspend accounts with false or incomplete details.

3. Virtual items & purchases

The Service may include virtual currency or items (“Virtual Items”) for gameplay. Virtual Items have no monetary value, are not transferable for money, and cannot be redeemed for prizes. Any payments are for entertainment access/features only. Purchases are final except where a refund is required by New Zealand law.

4. Acceptable use & community conduct

• No cheating, bots, exploits, or interference with gameplay or systems.
• No harassment, hate, threats, illegal content, or infringement of others’ rights.
• No attempts to sell, trade, or transfer accounts or Virtual Items.
• Follow any in-game rules and moderation decisions.

5. User content

If you submit content (e.g., chat, profiles), you grant us a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, and display it to operate and improve the Service. You must have rights to what you submit. We may remove content at our discretion.

6. Intellectual property

The Service, software, artwork, and trademarks are owned by us or our licensors. You may use the Service only as permitted by these Terms. No reverse engineering or copying except as allowed by law.

7. Suspension & termination

We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or users. You may stop using the Service at any time. Virtual Items may be forfeited upon termination for breach.

8. Disclaimers & limitation of liability (NZ)

The Service is provided “as is” and may be unavailable or contain errors. To the extent permitted by law, we exclude warranties and limit liability for indirect or consequential loss. Nothing in these Terms limits any rights or remedies you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable New Zealand consumer laws where they apply.

9. Disputes, governing law

Please contact us first so we can try to resolve issues. These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of New Zealand courts.

10. Changes

We may update these Terms from time to time. Changes apply from the date posted. If changes are material, we will take reasonable steps to notify you (e.g., in-Service notice).
